Bought My twin Patio new in 1974,Perhaps one of the first. Latest owner bought as a rental,& the Place has deteriorated badly. Problem started when a Truck pulled in and blocked My getting out of My Garage,as the width of the driveway is 20,3" wide. The Man did not live there,but stated that I previously asked Him not to let His dog poop on My lawn,which was a noted dumping ground a few years ago. At first He refused to Move ,until I went to call the Police. The Police interviewer,with whom I visited told Me never to knock on their door for any Nuisances,but to call them,which really made matters worse.

Then came the Music,to which I called as requested,but,by the time they saw the Police arrive the Music was turned off,& the Lady owner became hostile,& cursed Me out for asking that Her Sons Please turn the sound down. She called Me the word F*** a half dozen times before I hung up.

The Music has ended,but for the past couple of Months,there is a humming noise heard nightly,that reverberates other noises to My two Bedrooms,that make it impossible to sleep.
The Police,& Homeowners association,& owner have washed their hands.so the noise,& sound which I have recorded,& have Two witnesses,who also spoke to the Police,who stated,The noise was not load enough. Am 77 yrs old,with 45 percent of My Heart left,& wake up at time with chest Pains,& take Nitro Pills. Also treated for a lung tube blockage,& use two inhalers. Am not looking for sympathy for the last part.but for an idea to stop this existing problem.

Note; Visited My son in another state for a Week,& was driven to the Airport,by a Friend,and My car was stored in the garage,arrived after 9pm,& apparently was not noted for two days,then it all started again. Any help or ideas would be appreciated Thanks John

Noise violations are regulated by local ordinance. Have you contacted your local police or code enforcement?

Hatred is contagious, so one should work to avoid it.

If the perceived noise is not loud enough for law enforcement or the HOA to take action you have two choices:

Try your luck in a court of law - petition for an injunction - EXPENSIVE.

or

Move to quieter place far out in the country.

ps. ? ever hear crickets and the little green frogs ? - ! unbearable !

Not necessarily. Check with your local municipal court or equivalent. As I stated in the duplicate thread, in my state it is possible to obtain an injunction to prohibit harassment at no charge. The cops even serve it for free.

Maybe someone with experience in this area of Florida law will chime in here.

John if this is an every night occurrence, you might hire an off duty police officer to spend a night or two. It won't be cheap but they have the power to cite for noise violations and make an excellent witness if you have to file a formal complaint with the HOA.

If this house is being rented, have you talked to the owner about the problem, perhaps having him/her listen to your recording of the racket? Are there neighbors who've also heard it and are just as annoyed as you are? If so, perhaps all of you could talk to this owner and the homeowner's association about the problem.

If, however, the police and HOA can't resolve it, you might want to get one of those "white noise" machines that drown out stuff like this to help people sleep (places like Bed Bath and Beyond have them). Good luck!

This is not an HOA problem and should not be treated as such. Call the unit owner and/or the police.
