Hello All,
My board is having an issue with the PMC. Items that have been voted into the CC&R's, by previous board members, parking, towing ect. Are being questioned by the PMC. We are looking to enforce towing within the development, abandoned vehicles, vehicles parking on property from other developments ect. (We are not a gated community). But the PMC is telling the board that we need to vote on an already existing policy to enforce. Then reissue the info regarding the parking towing to all owners. Is this a normal practice?

Tony, if the restrictions are in the CC&Rs a Board vote would make no sense unless the CC&R restrictions on parking need further clarification. Reissuing the information prior to enforcement is an excellent idea. It is wise to periodically made owners aware of all restrictions for which problems occur.

Usually the board doesn't have the power to amend the CC&Rs. A membership vote is most often required. Possibly it wasn't a legitamit amendment.
