We're in an HOA where everyone gets along just fine expect for "that one guy" on the Board who wants to make a fight about everything (but then turns around and is the happy-go-lucky best-buddy neighbor to everyone else). We're coming up on our annual meeting and have received hints that he's farming the non-active members for their proxy votes. So out of 40 homes, he could potentially show up with 10+ votes to his name. Making any amendments to our laws on a 3/4 majority close to impossible. We're in VA. There is nothing on our books about a limit to the amount of proxies someone can receive. Because he is not addressing how he is going to be using their votes, is there any Va laws that could prevent this type of behavior?

Don,

Why do you need a law? He is doing just what any political candidate should do. Why are the rest of the candidates not out soliciting proxies? Remember that if someone executes more than one proxy that only the most recent one is valid.

I am not nor do I play a lawyer.

A later dated proxy overrides/replaces an earlier one. You have to "farm" your proxies after he does even if dated one day apart.

Remember. Vote early and often. I love good old fashioned politics.

Don's posting number is at zero. Therefore I suspect that he has resigned from the forum.

In case he is getting e-mails about the responses, the way to limit the issue is for the Board to start using Directed proxies vs. general proxies.

As others know, general proxies designates an individual to vote on your behalf.

A directed proxy designates an individual to vote on your behalf BUT directs them to cast the vote a specific way. It's as close to having mailed ballots without doing so.

BTW - the simpler way, since everyone gets along except for that one guy, is to collect proxies yourself or simply encourage others to actually attend the meeting.

I assume you are thinking we need to be logged-in to see the forum messages. We don't. The URL is the same whether or not we are logged in. Whatever we post, the whole world can find via search engines.

I knew that if you checked the be notified by mail for replies, you got the actual posting. However, I thought cookies were allowing you to remain logged in to see the posts from internet searches. I now see that that thought was incorrect.

Thanks for the info Eric.

Yes, he was trying to change his username and got frustrated and ended up Unregistering. Seem using part of your real name doesn't sit well with some.
