We are an over 55 adult community of single houses. We have a rule that allows visiting children to use one of the four pools every afternoon between the hours of 2pm - 5pm. However visitors that are older have no such restriction, they just have to be signed in by the person they are visiting.

The fact that there are different rules for different aged visitors does seem a little discriminatory. I just wondered if this is in keeping with the Stirling Davis Act?

In addition to being abhorrent it is DEFINATELY a violation of the Fair Housing Act.

Stirling - Davis does not apply.

Yes It does apply and there is case law to back it up.

I stand corrected.

It actually is legal in a 55+ community.

It remains ABHORRENT.

Would that all the 55+er's parents had hated children, there would be far far fewer 'old coots' (myself included).

This ability to discriminate against society's children is biblically abhorrent.

However, in the USA, if it is legal it must be OK.

? This is what my comrades at arms fought for and died to protect ?

We have ALREADY self destructed and our 'enemies' have already won.

No John. We signed up to defend the Constitution. The other laws are a result of Government. We only swore to obey them.

"I, _____, do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; and that I will obey the orders of the President of the United States and the orders of the officers appointed over me, according to regulations and the Uniform Code of Military Justice. So help me God."

The Oath of Office (for officers):

"I, _____ (SSAN), having been appointed an officer in the _____ (Military Branch) of the United States, as indicated above in the grade of _____ do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign or domestic, that I will bear true faith and allegiance tot he same; that I take this obligation freely, without any mental reservations or purpose of evasion; and that I will well and faithfully discharge the duties of the office upon which I am about to enter; So help me God."

I am aware of the actual oath.

I was metaphorically referring to the defense of liberty BS we were sold.

As in Tripoli and Halls of Montezuma (Mexico City) and Vietnam and the Gulf.

I find myself a converted Dove.

...life liberty and the pursuit of happiness...

It could be argued that our civic duty requires us to rise up and abolish the very concept of the HOA and restore: A man's home is his castle

codes for the purpose of public safety are acceptable

but what color I may paint my railings?

to be specific about civic duty:

...against all enemies, foreign and domestic;...

? if an HOA violates the preamble to the Constitution could or would it be considered a domestic enemy ?

John,

If you know the oath, you know the answer.

Tim,

I am struggling very very diligently to remain a patriotic American.

However, it is becoming increasingly difficult with each passing crisis and futile international involvement costing more and more lives in pursuit of ?

Then, when some elected power mad senile old coot tries to 'interpret' a crystal clear document to suit themselves and defends said actions with virtually unlimited resources, I empathize with the complaining HO who, negligently, had no concept of what an HOA was or that one even existed for their new home.

We must remember that this nation was founded by the actions of:

traitors

rebels

terrorists (a/k/a Minutemen)

who felt that they were performing their civic duty under God.

While an HOA is necessary to fund and maintain the common elements (mainly storm water facilities) they usually vastly overstep any rational semblance of perceived freedom by the general populace.

This will be the end of my rant.

Goodbye y'all.
