Hello, I am new to the HOA Thing and I have an issue in which I can not find the answer. I need to replace a water valve and called the city to come turn off the water to my house but they had said they only work up to the City Water Line that goes into the Whole HOA. Part of our HOA Fee goes to paying the water / sewer of our house. So they said it was HOA / My Responsibility. So I went out to shut it off myself and the Shutoff Valve is so rusted you can't even shut it off, the handle just bend's. So the Main Water Shutoff Valve for the house needs to be replaced. Our president says its on my property so it's my responsibility to fix it. I know with the city if its on the Water Meter Side heading toward the street it's the city's responsibility to fix. Would it be mine or the HOA's responsibility to fix. Part of it is under the road.

does your meter 'box' have an integral 'cock' type shut off ?

if so get a meter box key at your local 'big box store' for about $8

if not you will need an attorney and/or a plumber

Look in your basement for an inside shut off valve. If you can not shut it off then review your Covenants to try to determine who is responsible. Your Covenants may or many not assign that responsibility to the homeowner.

FWIW, for a townhome association we manage there is a shut off value in each basement plus there is an outside shutoff valve immediately beside the garage doors which is about 3 feet below ground level. When it becomes necessary to shut off water at the outside location it becomes the responsibility of their HOA.

What is a basement? None where I live. Typical master water shutoff valve here is in a box, with a cover on it, in the ground, about 4-6 feet in front of the house.

John in colder climates where you typically have to dig deeper to get the footers below the frost-line, we just scoop out all of the dirt in the middle and concrete in walls and a floor and viola you have a basement. The house is built on top of the basement with a set of steps to give access to it. Basements are useful creatures, places to put mechanicals, laundry rooms and more importantly a nice man-cave again typically with a bar, comfortable seating and a large screen TV for sporting events.

Seesh man I wish I had a basement. As far as I know there is no other shutoff valve except at the main road entrance. All this is in the front yard in a box in the ground that is ground level. Could you explain a little more about the meter key, the meter is one I think used by the city it has a code and a counter on it.

I was being sarcastic about basements. Sorry my sarcasm missed.

I well know what basement/cellars are as several of my homes had them but I am also familiar with non-basement (slab) construction this my advice.

John my answer was tongue in cheek, hence the description of a mancave. As to the OP, Roger has it right, you need to check your documents, somewhere it should describe where the HOA's responsibility ends and yours begins.

The President is not the final authority on this matter. Address your problem in writing to the board. Write to them in care of their statutory agent.
