Question: Are there statues set by the State of Arizona on where and when board meetings should be held for homeowners associations? If so, would you know the title in which it is located?

Scenario: in our CC&R’s, it states a 48 hour post on our community reader board that is next to the mail boxes on a scheduled board meeting. The board posted a noticed in the afternoon on a Saturday for a meeting held that Monday at 4:00 PM that is located in the association lawyers office that is 30 miles away from the community. This occurred on March 5th. Recently, I received an e-mail by mistake stating the next meeting is April 24th. I’ve asked what time it will be held, the management company said it would be posted in the reader with the allowed time (meaning, again the mid-afternoon on Saturday for a Monday meeting 30 miles away).

Can the board set these meetings that makes it virtually impossible for homeowners to attend in the mid of day and many miles away?

Go to that site and scroll down to Chapter 16 Planned Communities

The meeting has to be "Open" and notice has to be given. I don't see anything in the laws about where it should be held. Apparently the board members can get there, so whey can't some members? No matter what time of day, or location, there is never going to be many people attending, and there will not be a time that everyone will agree to. But I think the board is a bit far out on this.

I would go to the meeting and ask what the association is paying for using the attorneys office for the meeting. I would request that they hold the meeting closer to the community at an hour something like 7pm to make it more convenient for members.

They board should be told that if they make it more convenient for members, then they will get some input from members on issues and which will bring the community together better.

Check in the area of the community ahead of time to locate a spot, like a library or shcool where a meeting place can be had that is convenient and cost effective, and suggest it to them.

If they continue to do this, then the option is to discuss a recall.
