WHat methods have other HOA's used when owners make statement they are being profiled or singled out regarding courtesy notices. Our HOA PM acts independent with our our backing to walk through and cite infractions. There have been a larger amount and while everyone is not aware of who is cited there are those who state they feel they are being singled out.

LOL you are right on that one. It's not always fun living in a community such as an HOA that is for sure. Some have a harder time than others.

Our policy is that when someone makes a written complaint of an alleged violation, that we respond with what was done (that the violation exists and we have taken appropriate action or that the violation does not exist and the reason why).

Therefore, our response to those who feel that they are being singled out is to ask them to identify similar infractions in writing and we will investigate.

This tends to keep them quite OR we discover that there are other violations.

Additionally, in Virginia, by statute, the members may overturn any rule/guideline that the Board makes. When the member complains that the rule/guideline is improper, we simply point to the appropriate statute, explain to them what must be done to call a special meeting of the membership for this purpose and assure them that the Board would indeed hold a special meeting that was properly requested.

Typically, the individual doesn't want to go through all the work required to call a special meeting.

As Tim says. Put the onus on the complainer to justify their complaint.

It sounds like your PM is taking a stricter approach. I assume he is doing such at the direction of the BOD.

I have gone one additional step, request that the written letter also includes the section of the Bylaws that defines the infraction. No cases have come forward since.

Lack of transparency. That is the source of your problem why some feel they are being singled out. Even if transparency is against your rules, it still is the source of your problem.

Unless you actually are God(s) that would be untrue!

You would be claiming perfection.

Much better, and unarguable, would be:

"We are currently issuing violations as they become apparent."

Any violations would be based upon the Covenants & Restrictions NOT the corporate by-laws.
