We just hired a couple of attorneys who work together so of course they will check on this for us. But I would like to hear some of your views on this item.

We are a senior condominium (apartment style) in NE in one building with 43 units that was built by a church group and established as a condominium in February of 1981.

According to our documents (which we hope to update with the help of the attornies) the declarant (builder of our building) still has the "first right of refusal" before an owner can sell a unit.

Some of our owners are under the impression that the church group that built the building still owns the "common areas". It is my understanding that the owners of each unit owns the "common areas" (including the protion of the parking lot that is on our property.) according the the percentage that is assigned to his or her unit.

I think that the lawyers may come to the same conclusion that I have. But if this is the case at least it will have the weight of "a lawyer's opinion. If it is not true than we can work on correcting this problem.

It's going to depend on what is on the PLAT and deeds that are recorded with the County/State.

I am glad we will have some lawyers that will be working on this issue.
I did check the assessor's website a few months ago and could find none of the condominiums in our city litsted. At that time I assumed it was because one person does not own a condominium but the unit owners own the condominium.
What I did find is that the church group that built our building owns the Care Center adjacent to our unit. That was not a surprise. I also found that the church group owns one of our parking spaces.

Go have a talk with your Tax Assessor. S/he should know all the property that is part of the complex, and be able to show you maps, aerial photos, and all the data that goes into a property record for any your units, including the land.

Also, your master deed will contain a thorough legal description of the property that was used to create the condominium, often with a plat of the land or referring to a recorded plat that you can get.
