Our HOA president is a financial advisor. And I do understand that as board members, we are volunteers. I didn't feel comfortable investing with him; but that's not the real problem here. A resident that lives in our neighborhood has a lawn mowing business. He had the contract previously and lost it for various reasons.

I do know that this resident and his wife recently put all their investments with this board member, (president)....when it came time to vote on contracts for mowing, guess who got it..? Of course this "mowing" resident also lives in same cul-de-sac as 3 other board members, so that helped with the voting.

I discussed issue with management company, and they weren't concerned. I'm a little nervous about this. To me it's very unethical, but should I be worried about any legal issues?

Sad as it may seem, this kind of thing happens all the time not only in HOA but business as well (he who greases the palm, gets the business)

I just didn't wanna get involved in any legal issues. I love my community and enjoy volunteering.

Well, as sleazy as this arrangement is, it most likely is NOT illegal. What size is this contract anyway?

A very good way to protect yourself is to go on record in your board meeting minutes and say that you're opposed to this contract because no other bids were considered and because of the president's apparent conflict of interest.

If a residents bid is close or below other competing bids, I would have no issue with a local person doing the work. But just to make sure, you should call other vendors each year and ask them for an estimate to make sure your getting the best service and price.
