Am I allowed to work from my home while selling real estate as long as there are not cars taking up space and I abide by all rules and regs. Condo Complex is R4-Multi Family Residential in Colorado

You'll probably pull it off as long as you don't irritate your neighbors. Upon irritation, likely not. I'd think that is under your control.

Generally yes as long as no signage, no traffic, no noise, no smell, etc. If none of this, few would even know.

Another word of advice, read your governing documents about this. Our CC&Rs allow home businesses in our high rise towers and we probably have a dozen realtors working in their homes. Much "work" today can be done at home either one's own business or work as an employee for someone else.

If you are a Realtor who works for another agency and just making sales calls, etc. from your personal home then I would contend no issue. If you are planning on using your home residence as your personal Real Estate Office and registered business, then it would depend on your governing documents and local government codes and regulations.

I have friends who are realtors and they do much of their work from home. If someone works for a company and does work at home, that is not a business out of their home but just work being done from another location.

If you do not have traffic and you are abiding by all the rules and regulations โ€ฆ I agree with Steve.

The only reason I say this is.... some closed minded people that run HOA's are incapable of differentiating a business from someone working at home. So its better off just not saying anything.

Actually, this can vary from State to State as some States are adopting statutes discouraging Associations from taking action on certain home businesses. As an example, I offer VA ยง 55-513.2 (although this statute still defers control to the CC&Rs).

And, as I wrote above, JohnB, our CC&Rs do permit home businesses like "handicrafts," business services and others so long as no noise is involved. I don't know what CA state law may permit.

The general rule of thumb of it it's a business or not in a HOA is the "Shingles test". It's the old adage of "Put a shingle out the front door". Which means basically would your business require you to put out a sign such as "Dentistry, Doctor, Psychiatrist" or some type of professional notation? This is different than "Ice Cream shop".

Having your own indoor business and using a home office is between you and the IRS. However, it is between the HOA and you if your bring traffic other than deliveries to your door. Having to have a designated parking space is a good indication your violating the business rule in a HOA.

So as long as you do not advertise your business outside your home or use it as a place of business, then your okay. However, once you put your "shingle up" in the window, your have issues...
