Hello
Our documents call for the issuance of a Certificate of Compliance when homeowners complete the approved alterations or improvements. The ARC has never issued one that any of us have seen and since it is in the documents, we want to issue them accordingly.

It seems simple enough, but thought we should put it out to you all and ask what one would look like exactly to make it legal or compliant itself.

Sounds too much like baptizing your deceased ancestors.

Any reason why you can't just do this going forward? Maybe just make a list of grandfathered projects.

My guess would be a simple memo specifying that the item was approved and completed as approved.

I have seen an ARC Request that had a Completed, Reviewed, and Accepted section. Few homeowners ever requested such.

The goal is to do it from here forward, and Fred, although that is our intention, we have also been instructed by an attorney that you cannot grandfather anything if it is against the covenants. Covenants are a contract and we have to view it as such. And even my limited knowledge of contract law tells me that is true. You can't change a contract between parties without the full consent of all parties. Right?

So we can change items in the contract, (covenants) (if voted) and then we can grandfather items that are currently in violation. (those items that were allowed via the developer, who just said sure, go ahead even though they were violating the covenants. No paperwork or anything else.

Tim,

The form shown on that web page is not a certificate of compliance. It is a project approval certificate and at the bottom states, "This Certificate must be displayed in a location visible from the street at all times until a Certificate of Compliance is issued."
