I am currently president of a 66 unit condo association in NC. Last June we took over the ass'n from the declarant. At our annual meeting a 5 member BOD was elected. Three of the positions were for 2 year terms and two were for 1 year terms. I received the most votes and was ultimately elected president by the board and was to serve a 2 year term.
My question: Am I serving a 2 year term as president, or does the board re-elect officers each year? Can I be replaced as president after serving only one year? Our by-laws does not explain.

That depends on your by-laws. Read them and they should clear it up.

Hi Richard:

"Normally" the officers are elected each year by the Board, after the annual meeting. However, your bylaws should specify how things are done. Oftentimes, at turnover the people with the most votes get the longest terms, but it depends on how your documents read. Next year, after the annual meeting, the Board should hold an organizational meeting and choose a president; you may be chosen again, or maybe not; you might only want one year as president...

RichardD - Officers (Pres., VP., Sec., Treasurer,) are typically decided upon by the Board at the first meeting following the annual meeting. Officers typically serve at the pleasure of the Board members. For transition purposes, it's wise if there is crossover training in officer responsibilities in case a vacancy occurs. Since your by-laws don't explain, the decision is with the Board on conduct of business. You're the Pres. so bring up the topic of establishing a Board protocol and see how the other members feel.

Thanks to all for posting. After reading the by-laws for the umpteenth time they do say that officers are elected annually. All your responses were on target. This is one great forum.
