hello,

When an action was taken against a member {unauthorized changes of windows and doors} it was show that there a few other units that had other changes done which were withought permission.

1. these changes have been done a few years back and some by previous owners and could cost a few thousand $$ to rectify.

can the HOA give some kind of amnesty to these previous owners in CA.

there is no clear documentation in CC & R or the rules that says the HOA can or cannot.

It's possible for the Board to "grandfather" in certain changes that were made; it may be with a provision for a change later on (such as a shed that's grandfathered in during the time of ownership but when the property sells, the shed has to go) or perhaps approved retroactively. Particularly, if it's been a couple of years and nobody said anything, it may avoid lawsuits to grandfather in previous changes that can be approved.

You may want to consult your HOA's lawyer for advice in this area, before proceeding.

BalaK - even though the changes were unauthorized, the workmanship of the windows and doors may be quality and may be worth exploring as ones for the HOA Board to recommend to the residents for future installations.
