I'm fairly certain that we have a member running a business out of his home in violation of the bylaws. The member in question was a dentist in town, but after a failed marriage and a bad investment in a sushi restaurant he began to drink heavily and had to shut down his practice. Over the past few months I've seen a few young men coming to his house every week. I think he may be doing some dental work out of his home.

I'm thinking we could get a private investigator to solicit him for some dental work. Has anyone had success hiring a PI in a similar situation?

Personally, unless it was creating unreasonable excess traffic, I wouldn't care. Hopefully this is the case in your issue and not one of a personal vendetta against the individual.

However, regardless of the reason behind the concern, the State health board, zoning board and/or licensing board might have an issue if this is occurring. Therefore, if your that concerned why not simply report your suspecion to the appropriate city/county/State office and not worry about hiring a private detective to prove or disprove what you believe is happening.

Bylaws are the rules for your incorporated association; restrictions on how the property may be used should be in the recorded CC&R's.

Maybe he just has a thing for young men. Or maybe it's a young men's prayer group. Does he have a sign posted? Does he advertise? Is he soliciting business and directing clients to his home? You see young men and conclude he's practicing dentistry. What, only on young men? Where are the female clients? The older folks and the kids?

You are suggesting a trip down a slippery slope. Once your association starts hiring P.I.'s to spy on its members its only a matter of time before the members hire a P.I. to spy on you. And your wife. And your kids. Let the sleeping dog lie.

Have you considered the possibility your neighbor is distributing illegal narcotics to these young men? Do the young men frequenting his house appear to be of high school age? Have you seen the same young men entering his house on multiple occasions?

Larry, this reminds me of something that was on the news-feed here years ago. The HOA consisted of mini-ranches and the BOD was convinced that one resident had improper out buildings but because of the way the property was screened they couldn't prove it. Their solution, spend HOA money to hire a helicopter to overfly the miscreants property and take pictures.

I can see it now: Ads popping up in HOA oriented publications and websites offering the HOA a chance to own their very own drone. Battle tested, stealthy and capable of seeking out improper sheds and play equipment. Add the optional missile package and you don't even have to bother fining.

Do you know this neighbor? at all? Have you gone over to ask him what you have noticed? or are you just listening to all the "gossip" you've posted here? and you want to hire a PI? Good grief what is the country coming too?

Now you have even more gossip to spread around, he "likes" men or he is "dealing drugs". Good grief people! It's not even a full moon to describe the questions and then the answers that are being posted here. Carole is spot on.

This is ridiculous! Please only bring real issues to this board. A PI?? really? I just joined but these are an utter waste of time and I hope it gets cleaned up in the next couple of days or I will have to take my business elsewhere.

It has only been happening the last couple of days. It seems to have started with SamD2. It very well may be the same person using different log-ins. The issue has been reported to the moderators and, from what I've seen over the past 12 hours, they have started to take action (as I've seen some posts and even some threads being eliminated).

The moderators do this as a collateral duty so not all issues are addressed right away. However, the more individuals that file complaints, the quicker things tend to happen (as it gets their attention).
