So I normally rent out my home but now I am allowing my family to live there in return they take care of the property. Prior to this it had been vacant for at least 6mths. My Bylaws does state that Leasing is allowed in Open status, Leasing is considered if Owner accepts monetary gain and so only Owner occupant or family related or where there is no exchange of monetary benefits would it not considered Leasing. My HOA Board is requesting proof of family/relatives and when I ask what exactly would they like me to submit, the response is they were expecting me to provide something. Since this is not a paternity test does anyone have any suggestions?. This seems ridiculous if every time my family or my kids stays there I have to show proof we are blood related.

My suggestion would be a simple signed letter stating that the residents are family.

If the Association wants additional supporting documentation, tell them that you would be happy to provide it once they tell you what documentation beyond your written statement is required.

Thanks, I will send in a signed letter stating that. I did email them letting them know its my family and not tenants but I will send a certified mail.
