My neighborhood will no-longer have a HOA. I live right next door to the clubhouse and pool. I do not want to see this building fall apart and run down. How do I go about making it my personal property?

If the membership voted to amend or repeal the CC&Rs so the Association no longer exists, any common amenities would need to be sold, given or transferred to another entity to maintain. If you wish to purchase the amenity, contact your Board of Directors.

If you mean that the Corporation known as HOA, INC. is being administratively dissolved by the State, you still have an Association. The Association is just no longer incorporated but can be re-incorporated at a later time.

Your Deed Restrictions, commonly known as the Declaration of Covenants, Conditions and Restrictions is the document that creates an Association and specifies what authority the Association has. Until this document is amended or abolished (typically by membership vote of 67% to 100%) the Association will always exist.

Typically, Associations also become incorporated as this gives the Association and the members certain protections. Failing to file annual reports will typically result in the State administratively dissolving the corporation known as HOA, INC. When this happens, the Association known as HOA still exists and still has the authority granted to it under the CC&Rs.

Regardless of the HOA being dissolved, you want to buy a club house and pool? What an endeavor! I wouldn't want to see it go bad either, but I surely wouldn't purchase it either!
