Dear Friends:
On the subject of visitors parking I find a lot of unanswered question. I’m not sure
just how to
implemented such procedures or how they should be laid out. Can any one offer
recommendations that will cover Visitors parking, such as time frame, short and
long term use if
needed and authorized by the board. The management Company has offered no help. We have limited Visitors parking
area’s and I
find homeowners/Renter using them for the 2nd or 3rd car they have. A true time
frame for
visitors will help, also monitoring of vehicles and HOW warning should be
?Administered. At the present time I issue a typed letter and attach it to the
vehicle for a two day warning, then an official warning of towing after a 72 hr.
monitoring of said vehicle. Any and all help will be appreciated.
Need a little help if you please.

We don't limit visitors. We assign two spaces per lot and all unassigned spaces are on a first come first served basis.

If you really want to try and control use of visitors parking spaces you likely need to implement visitor passes and a towing policy. Prior to implementing any towing policy, make sure that you check with county/city codes on the association requirements that must be met prior to having any vehicle towed.

First of does your HOA own and maintain the streets? Are the streets in your HOA considered public? You need to establish the ownership of the streets before beginning to apply rules and towing policies. You can't erroneously have someone towed if it's not in your documents, posted somewhere, or it's not legal. If you have public roads, you can go to the city to make ordinances and codes with them for your HOA streets. We did that. We had our curbs painted red on one side of the street for no parking and an ordinance so the police could come in and issue tickets. If your privately owned, then that is another bunch of issues you must address.

Is it really going to be worth the effort? That's really has to be the first questioned asked and answered. Do you really want your HOA dues money to cover this expense? Then go for it.

The Association has complete and full control of the parking and the
roads. The parking is very limited at best, Verbal heated confrontations
have erupted due to hoarding of parking areas and visitors spots. Long
extended parking without concern of Homeowners or Renters by owners
that have more then two vehicles. They think they own the spots. Also
to note, the authorized parking spots that HAVE been assigned and
marked, - the problem still assist. If I can just get some idea of rules
that may apply I may be able to work it out. Just some guidelines will
help. It can be copies of rules association have at the present time that
can be used as a guide, No I will not put them in place, just used as a
guide to reset our own rules.

My overall advice is do not, do not, do not put the HOA in the towing business. It gets real ugly, real legal, real fast.

I do believe you are correct, I have found out that a HOA Association is the next thing to
socialism. I’m sorry I did join and be come a owner. It’s bad when the M.C. is non-responsive
and the people are un-concerned at best. Lost cause in this association, but then again the U.S. is
going the same way, or so it looks..

find out who the 'registered agent' is for your association

check the Colorado Secretary of State website for the info

THAT should be your legal 'point of contact' NOT the mgmt. co.

Your contract (covenant) is with the HOs as represented by the assoc. NOT with the mgmt. co.

once 'they' know that YOU know, see how they become more responsive !

So . . . your board, if you & others can get it to make a decision, can creates some rules for visitor parking. # 1 might be that it's only for visitors. Owners would have windshield stickers & wouldn't be permitted to park in VP spaces.

Vistors could be limited to, say, three days, which is our limit. They'd have a paper pass on their dashboards stating arrival time, auto description & license plate #, when they must leave and the resident's contact info and mailing address.

But we have security officers who enforce these rules. If an owner (or his tenant or guest) violates the rules, they are called to a hearing after the 2nd violation via US mail. The 1st violation also is sent to the owner by US mail.

If you don't have security staff, your board could direct management to do the enforcement. But you may end having to rewrite the MC's contract to include that work, which could cost your HOA more$$$.

How many VP spaces are there in your HOA? How many homes are there?

Oh, to finish. If the Board determines at a hearing to which the owner is invited (to comply with CA laws) that the owner (or his tenant or guest) has violated the rule twice, s/he can be fined $50. The fine potentially doubles (and doubles again) for further violations of that type within 6 months.
