Can condominium associations adopt absentee voting rather than using proxy voting for directors and issues? Does anyone have experience with this.

You would need to amend your documents but yes it can be done. What we did was change our directed proxy into a proxy and a secret ballot. Attached is the form we use, this allows homeowners that send in their proxy to have the same anonymity as the homeowners who show up to vote in person.

My state prohibits proxies in HOA's and condos. Both types of associations are required to permit absentee ballots and in-person voting. It makes life much simpler.

My HOA prohibits proxies and allows absentee ballots. It's in our bylaws. We are not condos though. I also believe it is simpler.

Calif. permits absentee ballots. But, Sara, does Hawaii? Check your state's laws.

In reviewing a couple of HOA's in Hawaii, Two of the three did away with proxy voting and went to absentee balloting, which in essence is proxy voting without the drama or potential problems.

The process to do this would involve amending or restating your governing documents, more specially your Bylaws. If you do contemplate making any changes make sure ALL documents match so there is no conflict in the future.

So, the answer is yes. but it's a slow and tedious process.
