Our board is considering limiting the number of non-owner occupied homes in our 55+ California HOA. Non-owner occupied homes are about 28% of our 4700+ homes. The board has made the statement that lenders do not like to make loans or may charge higher rates for loans made to onwer-occupied homes in areas that have a high rental %.
The opposition (the inveastors) states that this is illegal and is defined as redlining.
What is the truth is it somewhre in the middle.

Do you have a condo assoc or hoa the laws are different in florida on each.
I am the treas for 14 years of our hoa we have 309 homes and 3 lakes 10 miles of streets and roads,sidewalks etc.

Warning installthe rules asap.
1. No more than 10 percent of the entire community can be rentals.
2.Have a written down screening process
3. Do a credit check - background on all renters with a $50 fee payable by the landlord ( They are in the business to make money and could really care less about the community)
4. I ever arrested and convicted of a felony they are not allowed no matter what
5. If shown to be on your states pedifile list they are not allowed that is step 1 of the background investigation ( internet 10 minutes)
6.Set up a permanent comm to oversee this process
7.The comm has the final say so not the bod. They must stay independent of the BOD and the homeowners but make them responsible if a renter turns out to be a horror. Their votings are to be property of the homeowners assoc alone and must be kept confidential. Do not replace the comm members unless they make 4 major mistakes. Nobody is perfect.
8. Set up a means of appeal to the comm findings ( ie an outside arbitrator paid for by the landlord)then the BOD can overrule if the arbitrator finds for the landlord.Every home we have rented in 145 years of existance has become a horror to the entire HOA. But there is nothing we can do cause to modify our docs requires a 90 percent approval yes the developer Lennar really protected themselves. Try to get 90 percent of a 5 person group to agree on anything!
