We recently had 2 lots sold at auction and I provided our regular Estoppel Letter/Closing Certificate indicating fees to be paid at closing which included transfer fee and the 2014 Annual Assessment since due within 90 days of the close date. I've just learned that the closing attorney allowed the Purchaser to not pay the 2014 Assessments and wanted to know if this is typical or if I need to contact my state bar association and file a complaint.

If the purchaser had/has 90 days after closing to pay the 2014 assessment, there was nothing wrong with not collecting them at closing.
