Our HOA is in the process of updating and amending our Indentures. In trying to plan ahead, to see into the future as it were, we were wondering if anyone has any language in their Indentures about "Green Technology" or addressing any new things that might come up in home remodeling etc. that might need to be addressed by our board. Everyone knows about solar panels. They are becoming more prevalent. Also there is new materials for driveways, gray water tanks, etc. etc. We sure would like any advice on how anyone else might be handling these issues. Thanks!!!!

Your post has been up for a couple of days and received no responses.

I didn't respond earlier because my Association doesn't look into any specific technology. Our guidelines are specific on what may or may not be allowed and may have specifics on styles, colors or locations. However, they are not so specific that they prevent new technologies. As an owner wants to look at the technologies, the Architectural committee, or other approving authority, will consider the issue on the merits of the issue.

If there are issues with a guideline preventing a new technology and the Association/membership wants to allow the technology, the guidelines are easily changed. If the technology is prevented by a covenant or Bylaw, then it's a little harder to change but it can still be done.

Thanks for your response. We are not wanting to prohibit anything persay, but as we are in the process of updating our Indentures, we are looking at any issues surrounding "green technology" that we may not have thought of. Of course, we will stipulate that ANY changes or updates should be submitted for approval and I was just wondering how other HOA's might be addressing this or how they "word" it in their Indentures. Boy, you could have gray water tanks going up in backyards, rain chains, permeable drives etc. Actually, I would be the one thinking it was cool and wanting to do it myself. So many changes so fast. Well thank you so much for taking the time to respond. When I read some of these topics I realize how we are not as near as prohibitive as a lot of other HOA's. You have yourself a lovely evening.
