Can anyone verify the Texas Law implemented in 2009 allowing delinquent homeowners to vote in elections. Our managment company is stating the law does not pertain to condos it is only for single-family homes for those living in subdivisions.

We don't seem to have many folks from TX visiting this site, at least not on a regular basis. How 'bout just asking your PM to show you the actual relevant statutes. Are you on the board, Marlene?

a quick google search didn't pop much, but the advice given just before mine is best. Pretend you are in Missouri, and not Texas, and ask the person making the claim to show it to you in writing.

The TEXAS RESIDENTIAL PROPERTY OWNERS PROTECTION ACT does not apply to condominiums. See Sec.A209.003.

If your condominium was enacted after January 1, 1994Title 7. Condominiums; Chapter 82. Uniform Condominium Act would be applicable.

Per Sec. 82.102, unless your CC&Rs say otherwise, the Board may suspend the voting privileges of or the use of certain general common elements by an owner delinquent for more than 30 days in the payment of assessments.

If your condominium was enacted prior to January 1, 1994 Title 7. Condominiums; Chapter 81. Condominiums would be applicable.
