I'm secretary for HOA in south carolina and I'm trying to figure out if a lien placed by our previous HOA Management company needs updated. We stopped their services but one house still has a lien on it. Additional fees etc are due and our mailing address is different than the HOA companies. I can't find any type of form or info about that in South Carolina.

If the lien was recorded it would be a good idea to record an amended lien to reflect the change of address and additional amount owed. You are unlikely to find a pre-printed form, so take the d-i-y route. It might be as simple as something like this:

Amended Lien

The ABC HOA, Inc. hereby amends the notice of lien recorded on page 1234 of book 5678 as follows:

The present mailing address for ABC HOA, Inc. is 1234 S Main St, Pumphandle, SC 23456;

The amount of the lien is $99,999.99.

Signature and title of corporate officer

One thought, however: If an HOA in SC records a lien for say, $1,000 but each month that amount grows by another $100 due to additional non-payment is it necessary to record a new lien each time a payment is missed? Or is it sufficient to merely state that the association has a lien without stating a dollar amount?
