I am the Secretary of our newly turned-over HOA. (Single family residential)

The subdivision is about 1.5 years old and with tax season in full swing as well as the weather warming up in the midwest, homeowners are itching to outline their propeerties with fences.

My question is what are the "rules", if you will, regarding fence sharing or "piggy backing". If a neighbor installs a fence and tie into an existing fence does he have to ask permission? Assuming the fence is on the immediate property line is there an encroachment issue? And more importantly...down the road when someone damages the "shared" fencing, who is liable?

I don't have an official answer but I can give my opinion.

Part of the ARC process in our community requires the Owner requesting a change to get signatures from two neighbors (to the sides, diagonally and across) agreeing to it. You can also require the fence owner to lend his permission. In order to enforce it you will need to create a written process, have the board of directors ratify it and distribute it first.

Of course ACC approval is needed but I think you will find county, town, or city laws or ordinances governing this also.

Architectural review is required before any project begins and if a neighbor is going to join onto their neighbors fence, then yes the Owner of that fence would have to sign off with their acceptance.
