I live in a bundled golf community in Naples, Florida and we have anHOA and Architectural Review Committee; we have now decided that certain exceptions apply to the ARC mandatory request form and we want to develop a form which comprises a NOTICE, only, to the ARC that a repair/replacement project will take place, which does not require traditional approval. Do any members have any language which could be used for the NOTICE.

We chose to address each possible item that may be repaired or replaced directly when we adopted our policy on ARC procedures. These include:

"Approval is not required to repaint or re-stain a home using the same color originally employed."

"Replacement of the fence and/or gate with the same style and picket width do not require Architectural Committee Approval. However, replacements of the fence and/or gate with the same style but a different picket width require ACC approval"

"Except for the repair of a broken window pane, replacement of windows requires prior approval from the Architectural Committee."

"In general, recreation and play equipment that is not in use must be stored within the rear enclosed lot or within the home.

Temporary, moveable plastic play houses, sliding boards, sand boxes, etc., do not require the prior application for approval to be submitted to the Architectural Committee; however, as with all personal property, they must be stored out of the common area, front yard, side yard or adjacent lot view when not in use."

"Replacing an existing roof with the same shingle style and color does not require Architectural Approval. Architectural approval is required if a color or style change is desired or if the existing shingle color or design is no longer manufactured. "

All other items, lights, gutters, etc. require approval.

There is a small communication gap; We know which items we want exceptions for; we wish to know what type of notice protocol language to use.

We didn't actually publish a notice. We simply adopted the resolution and published the resolution.

Oh boy - Virtually none of our homeowners do not know what color was originally used on the home (even thought all that information is on our website), nor doe they know the manufacturer and they are drawn to the big box stores. They just go to Big Blue or Big Orange and wing it, painting the home with whatever color they like and then ask for forgiveness and approval for the pink shutters.

This is what we sometimes get when they try to "match" the orininal color. One contractor took down a 15 year old shutter that was totally faded and chalked, matched it and after they painted, it looked just like it did before they painted. They have also printed mcCormicks chart from their website, marched off to the Box stores and asked them to match the color of the paint using the print job that came off their ink jet printer. (Oh Boy). They have also taked the McCormick Color chart to the vendors and asked them to match the color based on the small color sample. Most of the good paint stores have formulas and can match each other's paint with a sample. This has been a nightmare.

Do you have a base line color chart showing the original manufacturer and color? Tks.

Yes we do. We contacted the manufacturer (McCormmick) and requested it awhile back. These are available from the Architectural committee.

Having the colors on the website is an excellent idea. I'll look into that.

We do provide each owner with the color name, manufacturer name, manufacturer's paint model number and addresses to the manufacturer's paint stores in the area in the disclosure package.
