When our association was originally set up the bylaws were created wrong. Someone gave us condo association bylaws. We do not live in condos. We have about 10 stick built homes in this small subdivision. We are now trying to set up correct subdivision bylaws and we are having a hard time finding a generic version or template we could use. Can anyone help us with this?

Your state may not have separate rules for condos. In my state of Alabama, there is no separate listing for "Patio homes". When I claimed my homestead exemption at the tax assessor's office "Patio home" was NOT an option. It either had to be "single family" or "Condo". It was acknowledged that Patio/town homes exist but they are not catagorized as such. You may want to check that out with your own tax assessor's office as well.

I'm from Michigan. Your documents are probably not a mistake. It sounds as if you were built as a "detached condominium" under the Condo Act. That is a very popular housing form around this state. Looks like an HOA but is legally a condo.

You're going to have to go through the Condo Act to see if there is any way to dissolve or convert the condo and re-form as an HOA. Believe me, you're going to need an attorney to do it because of the differences in how ownership of common areas is handled.

To my knowledge, there are no forms for creating an HOA in Michigan.
