First, this is a new neighborhood and the HOA hasn't even been in effect for a year yet. I followed all the rules and contacted the HOA before we started our building on our lot to get approval. We gave the drawings to the Pres. and the next day he told us it was approved and signed the drawings. We have already started construction and now the other 3 board members are telling us that they didn't know anything about the building and that all of the board members had to sign the drawings to approve it. It doesn't state in the bylaws that every board member has to sign to approve any new structure. So my question is, am I ok and do the board members need to work out this mis-commication among themselves or do I need to hold off on the building?

Alisha, I would ask the President to call a special Board meeting immediately to resolve this matter. It appears they have not established proper procedures for architectural committee approval. Meanwhile, I would immediately ask the President to sign your WRITTEN REQUEST WITH THE ATTACHED BUILDING PLANS. After getting the President's approval in writting (not just signing their name on the plans) I would proceed with construction unless it does no harm to wait until after the meeting.

If I am not mistaken the President by default is "headchair" of all committees...if he signed off on it...then its a done deal.

Exactly Marty. If there is no ACC board, then the President acts as the ACC chair. The President should have called a meeting with the board members, but may not have been required. It would have just made things go a little smoother for everyone if they had. (I know, I got called "dictator" a few times if I didn't have a board member around to agree)

By no fault of his/her own the President because you are new, may also be new to this community living thing. Like Roger said the board needs to set policy and guidelines following the CCR's for your community.

If the President did this in writing on his/her own and the others are contesting it. Before going forth with it and possibly having it be more trouble for you, like Roger stated ask the Board for an audience with the entire board for them all to sign off on it.

Your board should solict volunteers to serve on committees and one of them should be an ARC review Committee. Have your board set procedures and guidelines following your CCR's.
