We have a rather small subdividion in the Houston Texas area. Our BOD like so many others I have read about in the articles have had little to no training etc. We have been approached by a Little League team that wants to use our Ball field for their practices. One homeowner has mentioned something about us losing our "Private Club" status if we let this team use the field. They have offered to do some maintenance to the field to bring it up to their requirements in exchange for their use.
Are there any guidelines set"in stone" that we cdan go by?

You may want to check with an HOA attorney, but I don't know why you would lose your private club designation.

It sounds like it may be a good deal if they will do some maintenance to keep the field in shape.

After getting an opinion from an attorney you could consider signing a contract with the league authorities spelling out the rules, the agreed on maintenance, and a requirement for them to maintain liability insurance with your association named as a covered party. That's to protect you from any injuries that may occur while they're using the field.

Before talking to the attorney, work out a tentative agreement with them for the maintenance and the insurance coverage and let them know that you'll work with your attorney who may have some other stipulations.

If they won't agree to putting the maintenance agreement and the insurance stipulation in writing, then I would drop them and not spend money on the attorney.

Since you have a ball field, I assume some of your members do use it? Wouldn't those who use it have some say in this? The reason I ask is because we've had posts here from HOAs with swimming pools that were taken over by swim club(s) thereby excluding members from using their own pool when the swim club was using it. Not a good situation. It's great if these players want to help maintain the field - at least the members aren't paying for something someone else is using. Is it a lighted field? There's another expense. Liability definitely should be covered. Good luck. Harold

Fortunately or Unfortunately, not many members use the field. However; part of any agreement would be that the homeowners would have priority.
