I live in CA, been living in my complex for 3 years...but the HOA process is still fairly new to me.
When the HOA sends out a notice for a reported violation does it suppose to state how many days are given to correct the violation before any disciplinary action takes place?
I ask because every week for 3 weeks we got a notice, stating the violation and to remedy the violation. At the third violation we were scheduled for a hearing.
This was due to a pet violation...the family was housing 2 dogs temporarily for a family member after a relationship breakup, dogs had no place to go. We did notify after the 2nd notice that the dogs were only here temporarily and finding a home was just taking a bit longer than expected. Dogs were removed a week prior to getting the 3rd notice.

whether it was affordable is NOT the HOA's problem

seems like you had weeks and weeks of notice and ample time to comply with your CONTRACTED obligations

Or were the violations for barking, i.e., noise nuisance?

Your own Rules & Regulations or CC&Rs should spell out violation procedures. Per CA Civil codes, you must be given written notice before you attend a hearing. In your case, I would think the board would waive the fine since the dogs are gone. Or they might suspend the fine pending no further violations of that type.

If you go to a hearing, do not try the no-place-to-go excuse. It'll only make things worse.
