I was wondering if my ARB has a conflict of interest. It is a 3 member board, and two of the members are related (mother/daughter). They live in seperate homes, but this just doesnt seem fair to me. If either of them wanted to approve something outside of the C and R they have an unfair majority. I approached the President of the HOA and he surely didnt see my point of view.

I see your point. However, not even the Board may give a waiver to any Covenant.

The best way to minimize the perception of unfairness is for the Board to adopt Architectural Guidelines. The guidelines are then used to minimize personal tastes from being the deciding factor (which is where the mother/daughter may side together).

One other option would be for you to request a hearing before the board, mention your concerns and then offer to serve on the committee in place of either the mother or the daughter so as to minimize any perception of unfairness.
