Hello! (NC resident) i'm very unhappy with our hoa, boa, and management co and how they handle our finances. all of it is very unorganized!! i have lived on my property for 5yrs, never been notified of hoa meetings. (found out that there has not been a meeting in 2yrs). also no one in my community really knows who is on the board. according to our statements we are paying the management co to pay hoa ins and electric bill for our street lights. they don't provide any other services. i would like to call a special meeting in rearguards of all of this. we need a new boa and there are other community issues that need to be address.
how do i go about calling this meeting? is there a format i have to follow and if so where can i get it?

Look in your Bylaws. It will tell you the procedure.

Typically a "Special Meeting" may be called by the President, the Board of Directors, or 25% of the community members. Yours may be the same or slightly different.

If it's 25% of the members, then you'll need to get signatures from that many people, and hopefully many more in order to call this meeting.

The management company must tell you who is on the Board of Directors, and contact them for you. You can get a list of questions and have the management company get answers for you.

You can obtain from the MC a copy of the minutes for the last few years, and a copy of the latest financial statement, and reserve study if any has been done. You can also get a copy of the management company contract and you should.

Get all the information you can. Then develop a plan with several community members. In order to get people to a meeting you will have to sell them on the specifics of what is wrong and why the meeting is necessary.

Planning is the key. Without planning, there will be chaos, and people will become disinterested and nothing will happen.

Read your CCR's and Bylaws. It should state that you call a Special Meeting for the sole purpose of electing a new board. Without knowing what your governing documents states, its difficult to say exactly how to go about it. Your MC must tell you who your board President is, you can either a) bring a petition to him/her with the required amount of signatures on a petition to call this special meeting for the sole purpose of electing new officers to the board, or b)ask him/her to convein this meeting. Look into your doc's and see what they say.
