Our community of fee simple townhouses has an HOA that was never registered by the builder who ran it. The builder let the HOA lapse and we don't know how to get it re-started. As far as we know we are not a condo community because our deeds say fee simple townhouses even though some of these townhouses are one story ranch style. We talked to a lawyer but we don't have enough money to pay for his services. Our community is in Adairsville, Ga.

Sharon I would start with the Georgia Secretary of States office to see if the corporation that is the HOA was ever registered or perhaps was allowed to lapse for non-payment of fees or failing to file a report. This can often be done online.

We have a similar development.
When you say the Builder let the HOA lapse does that mean:

1) that the HOA is no longer actively ran?
2) The Corporation known as HOA, Inc is administratively dissolved?
3) The deed restrictions were not renewed?

Each of those meanings have different solutions.
