Should a HOA allow residents to park their cars, or their friend's cars in a vacant/foreclosed property/townhome overnight. Just because its vacant, the neighbor feels his guest should not walk around the cnr. to the visitor's parking lot? BellaM2

Our community has several vacant units and other residents use these driveways all the time. We have taken the position that it is not an Association issue, but one between the unit owner and the borrower of the driveway. The unit owner could have them towed if they wanted to, but most of these units are basically abandoned and the owners are nowhere to be found.

Nope. It's still someone's property, whether it's abandoned or not. The other day, we were having our big block party outside my house, and I sacrificed my parking spot for the event. I ended up trudging it in from the visitors parking. I was going to park in the driveway of the abandoned house across the street, but then I realized at any time a property manager or realtor could want to go there, and it's not my place to use that spot.

I don't think the HOA should be in the parking business, but if someone is willfully trespassing, you're more than within your rights to tell them to head over to visitor parking.

Selling vacant houses in your neighborhood is important for property value, so who wants to impede a realtor's ability to do that?

We don't get involved in that issue unless the individual who has the assigned space complains to the Association. When that occurs, we would first try to locate the owner of the vehicle and if that fails have the vehicle towed.

Our bylaws have a collections policy and they also say that parking, voting and pool privileges can be suspended in cases like this. The spaces are assigned common area and they are not deeded. When parking is suspended it's suspended for the tenants and their guests.

Thank you Laura, its still someone's property, when other people leave oil spills etc. in driveways and the driveway looks ugly who cleans it up?. Certainly not the next door neighbor who uses it.

Should the hoa turn a blind eye? Yes.

It's much better to have a car in the driveway and appear someone is living there than a house that look vacant. Vacant houses get vandalized, broken into, etc. I dont feel the HOA should get involved, its private property and the owner is not complaining.
