Like many buildings ours had CCTV in a few key places in the building. Lately there have been issues from people trespassing to making problems in the lobby to HOA flyer removal.

Oddly enough, one of the biggest problems stems from a homeowner and his spouse. His spouse has caused many internal issues in our building, rule ignorance, etc.

Our trespassing issue was caught on video a few weeks back. The individuals who were seen and photographed climbing a fence... telling people they live here etc has been traced back to this homeowner's spouse.. friends of hers.

Homeowner was put on notice and hoa posted flyers of individuals who were seen on property asking for homeowners to call police etc. the flyers had color photos of our a family who live across the way... and yes police reports filed. Trespassing is a minor issue though in the way of the law.

Homeowner responded to HOA saying "he doesn't have a wife" and I have video of him removing flyers with the pictures of those who entered our property.
He denied he did it, and our color camera shows other wise..

Our BOD decided since he was put on notice to just go ahead and fine him for continued rule issues..

CCTV does have advantage, but short of fining for issues and rule infringment we can't seem to force anyone to executive session.

Meanwhile I saw "the person who isn't his wife" on his balcony yesterday tossing a cigarette but on our common property.

Do you have the right to fine for this? Do you have a fining schedule? This is still a police matter and not HOA. The HOA could press charges against him if they want for destruction of property. However, this could make things worse. Just call the police and keep records.

Yeah, I'm kind of confused by this. Is this offending party someone who owns property in the HOA, or a neighboring property to your development?

Executive Session is the option of the alleged violator. If they want the issue discussed in open session then discuss it in open session.
