The HOA board just allowed two renters to join the membership. When a director was questioned on this the answer was "yes technically". When asked to please explain "technically" This was given as his answer...."the owner of home has become a member and therefore the two are his proxy" The owner of home does not live here in our mobile park, these two(cousins) have been renting for now two years. The land is owned by a Corp and we pay lot rent. The HOA by-laws are pursuant to Chapter 617 & 723. Membership in by-laws now state: Members...person(s)holding a valid FL certificate of title to her/his home located in (park name)are eligible to become members of the Assoc. A valid FL issued title certificate is one for which all taxes due thereon are paid in full. So our question is how can they join the HOA???

They can't but maybe by the owner's proxy. However, even then the owner is responsible for paying the dues. The renters may pay the dues on the owner's behalf in Florida to avoid foreclosure. Why the owner would not want to pay the dues straight themselves is beyond me as it is a tax write off for them. I say as long as they are not board members I would be okay with that. They can be on committees and help out around the HOA. Just should not be board members.

The owner of this mobile home has brought a house(stick) in another town in FL. If we who own our mobile homes wish to join the membership of the HOA then we do pay dues, if not we are still considered members with no voting powers. The owner of this mobile home in the park and the renters are all cousins.

What do your by-laws say about membership and proxies? Ours specify only the property owner is a member of the HOA and only members can attend meetings. Proxies can only be giving for voting, not attending meetings.
