My board is not acting with some home owners who are violating the CCR's of our community. What can I do and is there a government agency I can go to in Illinois?

You should check the state's attorney general's office to see if they have a consumer protection division that handles complaints

But before you do that, what are the violations? How many homeowners are we talking about? Is the violation creating a nuisance to you and other homeowners? If so, have you spoken to the board about this? Did you check your CCRs to see if it really is a violation? If you spoke to the board, what was the response - and if you haven't, why not?

If other homeowners are equally honked off about the violations, ALL OF YOU should attend the next meeting and say so, and then ask what the board is doing to resolve it.

You may enforce the covenants by taking the individual violators to court.

You should read your governing documents. Most of the CC&Rs I've read give the authority to enforce the governing documents to the Association, just as individual members have a right to enforce. However, there is no requirement that says a member or the Association must enforce.

Perhaps there aren't enough volunteers to do all of the jobs required of the Association. If this is the case, you can volunteer to take on the enforcement tasks.
