Is the HOA financially responsible to make repairs due to wood rot to the all of the effected potions of outside windows of the units in the complex?

Well here's the deal with that... The HOA's money is ALL of the homeowner's money. A HOA is ONLY funded by it's members for it's members. So if there is such a mass/large damage on most everyone's windows, then the HOA can agree to be responsible and pay for the repairs. However, as noted that could mean a special assessment of ALL the members to cover the costs. Be careful of what you wish for sometimes...

Your governing documents probably spell out who's responsible for many features of your buildings, Tom. Take a look at your CC&Rs. In addition, have funds been set aside for this in your HOA's reserves?

Sounds like your units are attached rather than detached homes, is that right? What size is your HOA? How old is it?

I have looked ar the By Laws of the Association. It defines a "unit" as the space between the walls. I do not know if funds have been set aside for repairing the windows. My sense is they have not or the HOA would not be deflecting financial responsibility for the repairs. The HOA has indicted they will pay to repair the sills and brickmold..but not the piece of wood between the sill and the metal part of the window frame. That piece of wood is where the wood rot exists

Thank you for your reponse. I am very familiar with the the funding of the HOA as I sat on the Board of an HOA in the past. That Association repaired and maintained all of the grounds and the exterior of all of the building--so this particular issue was never a topic of conversation. I also understand the use of reserve funds that are set up to replace major components of the Association property and the possibility of a Special Assessment in the event of an expense which is out side of the normal operating budget and for which reserves have not been accumulated. I am simply interested knowing if the HOA is responsible for the repairs given that the rotted wood is on the outside of the building which houses the unit. The By Laws of the Association indicate that a "unit" consists of the space between the walls.
