Greetings. I'm a board member of a 72 unit community in Pa. It's been over a year since last home was sold and we cannot get the builder or twp to help complete remaining punch-list. We recently determined the twp. allowed the performance bonds to NOT be renewed and the builder was recently purchased by Ryan Homes.

Any help, advice is appreciated.

CS5,

Had the township not released the performance bonds, I would have advised you to make a claim against them. Unfortunately, with the bonds released, the Association will need to persue with the original builder or the company that bought them.

I would recommend that you contact a local attorney to see what your legal options are.

I agree with Tim--see an attorney. You don't want your HOA members to be stuck with the bills to finish the punch list. In addition, you don't want any relevant statutes of limitation to run out of time, which also could mean costs to your HOA members.
