Hi all;

We recently held a recall for a BOD member, and it was successful 68%, 32% against, with a healthy quorum (71 votes out of 134).

One of our action items is to notify the recalled BOD member of the need to turn over all passwords, records, etc., to the BOD president.

Does anyone have any samples of letters notifying the recalled BOD member of the results and the expectations of turning over records, etc?

Thanks! This group really helped us get this together, and we are elated by the results which were just counted yesterday.

Are you a member of this Board? Was the recalled Board member not aware of your effrots to remove them???

And I would hope someone had enough foresight to make sure any passwords, records, etc. were not then allowed to be in the sole possession of the recalled member. Anyone else have these passwrods???
How about records doesn't someone else have copies?? The MC???

My guess you might be met with some resistence in your effrots after the fact to have much in the way of cooperation from this recalled member.

And finaly my guess unless they have been out of the country there is no real reason to notify them of their removal. My guess they know.

That individual should simply be invited to the next board meeting for the purpose of turning over all records and/or passwords associated with the Association.

Depending on the position, you may also need to update signature cards at banks.

Thank you, Tim. Great advice. I have since learned that she will be out of state for the summer. There will be at least three BOD meetings before she gets back. Any thoughts?

Sounds like the former Board member has made plans for life after Board service. Hopefully, your Board has made plans to operate without her. So if she is gone for 3 months what suggestions might you need?

Can you not change the passwords???

IF this person were allowed to be the only one who has in her possession the passwords now required to function sounds like the recall party might have gotten ahead of themselves.

If she hasn't left yet, have the President give her a call and arrange a time to meet to collect association files and/or passwords. Then have 2 people show up at the house on that date.

If they have already left, passwords can be sent via e-mail and once received, changed. The files can be picked up later. OR if someone watching the house make arrangements to have them provide those files.

Well done on your part. Shows the naysayers that it can be done.

As part of the recall, did you elect someone to replace the recalled person? In most associations the BOD (among themselves alone) can appoint/elect someone to fill a BOD vacancy.

I wonder if a BOD could appoint someone that had been recalled?....LOL

Hi John,

Our bylaws allow for a replacement to be elected by the membership. I think there would be a mutiny if the BOD appointed the recalled member. Lol!
