Does any-body have a written house painting standards policy that is being use instead of just the phrase " lots will be maintain" which is the only reading in our CC&R's? The last two Board Presidents as well as the current Secretary have personally done the paint list,which is done every-year, have spouses who are in the painting/construction business - I found a Code of Ethics/Code of Conduct on Davis-Stirling that I will push the Board on at the June Annual meeting to adopt to end this Crap that going on - our HOA is only 9 years old but some people have painted their homes 2x already or face $200 a month CC&R violation fee for not "maintaining there lot". Yes there is something wrong here and we,the residents, are trying to stop the bullying and make clear the grey area's in the CC&R'S. Need all the help you have to offer thanks!

The community may only be 9 years old, but developers are notorious for using all sorts of cheap stuff to get the houses build and sold - only for the homeowner to fix things that shouldn't have failed so quickly and then duking it out with the warranty company (if there is one). Had there been a problem with the paint before the developers left? If so, were the homeowners informed on what was being done about it?

The president and secretary may have spouses who are in the construction business, but that doesn't mean they were the ones doing the work? If people were pressured to hire them or face fines for having a bad paint job, that's another matter (as long as people paint the house an approved color and the work is of good quality, the Board shouldn't care who does the work)

Are you one of the residents who's gotten a notice about the paint on your house? If so, what did it say? Did you attend a meeting or send a letter (I'd do both) asking for more details on what the problem is? Have these other homeowners complained to the board? If so, what was the response? And if no one likes what the board is doing, why haven't you and the other owners voted them out?

Answer these questions and then we'll go from there.

Simply get organized with other homeowners and vote them out next election. If someone is unethical, signing a paper to follow ethics won't stop them.

Duane, Does the past or current Board require homeowners to use certain paint or construction firms??? If not, there is no conflict of interest that seems apparent.

BTW, what is a "paint list"?? A list of houses that the Board says must be painted that year? Or what?

Do your documents, perhaps your CC&Rs require an architectural committee? Some, like ours, do.

At your June Annual Meeting will you b electing directors?

I live in condo-townhouses and our architectural guidelines specify the brand and color of the paints we use.

The paint list is a list of homes found every year that are " faded,have paint chipping, rot,mold" and what ever else they can they can think of! The fact that this list is done every year tells me this is no set standard - done by a different person each time. I e-mailed the Board about making a policy letter on this issue with the standards for the residents because if you(BOARD) don't inform us of the standard then how will we know when to comply. The only way I found out was by being informed by the PM - it's a common sense thing! Then why are the same homes getting letters every-year with different faults - I think this is where the problem is(different inspector/faults) every time that is why I'am looking for or pushing the Board to make a policy/standard letter to end the B.S.
