Our NW Committee was dissolved at will and keeps using the name of our association on their literature. Aren't they suppose to remove the association name from their literature? Thank you

The NW should not be connected to the HOA at all even if they are the same people/members. Now there is some gray area here. Your neighborhood could be named the same as your HOA. It just does not have the "Inc." attached to it. So to say they cannot use the name of the neighborhood may be the confusion and issue. I say okay as long as it is not saying HOA or Inc.

Send a registered letter requesting that they stop using the name (and keep a copy.)

I agree with Fred. Many HOAs, though incorporated like mine, do not use "Inc." as a part of their legal name, e.g., the name on our Articles of Incorporation does not include "Incorporated."

Legally, we are "BayView Owners Association" (not our real name). If an unsanctioned committee called itself the Bay View Neighborhood Watch, owners could easily & reasonably assume that the committee had board approval. Better to avoid any confusion.
