Is there such a thing as a listing of Attorneys who are experienced in HOA law for both HOAs and Homeowners?

One thing to remember is that even though COA/HOA has some unique issues it seems to be simply a combination of contract, property (which is based in contracts) and corporate law.

Therefore, an Association should probably look for a firm that handles both contract, property and corporate law. An individual should probably look for an attorney versed in contract or corporate law depending on the issue.

Like a mediator?

You usually go to an attorney that is well known for or specializes in a certain subject. You wouldn't go to a doctor who specializes in "people". You don't do that for lawyers either.

You might try contacting a local chapter of the Community Associations Institute (CAI) for recommendations. Most HOA lawyers are members of CAI. You can search for CAI chapters on the internet.

I just googled HOA attorneys for my county and quite a list turned up. It also depends on whether you want a law firm to handle your collections as well as be your general counsel.

We have one firm as our GC and a separate one who handles our collections. Yesterday, however, we (our Board) interviewed senior partners of three firms that do both.

I'm not sure what you mean by a firm that's experienced in HOA law for homeowners: A firm that would take a homeowner's case against an HOA? Are you on your board, June?

The attorney deck is really stacked against homeowners. Almost all attorneys trained in association law will only represent associations because that's where the money is. If you are a homeowner, you need to check out attorneys specializing in consumer protection and see if one of them will help you.

HOA's must be represented in court by an attorney since it is a corporation. They represent the HOA as a WHOLE. NOT the individual members seperately. It is not about the money why they represent an HOA.

A lawyer with contractual, business, or corporate law background is a good reference. I do not recommend Real Estate attorneys for HOA members. The issue is most likely not real estate related. It is violations of rules and deed restrictions.
