Due to health issues I will be unable to attend the annual meeting can the officers refuse to give me a copy of the agenda prior to the meeting ?

It may be the agenda is still being prepared - did you ask why you haven't been given one?

If you can't attend, does your association allow for you to assign someone to attend and cast votes on your behalf? You'd probably need a proxy for this, so find someone willing to do this and complete the proxy (you might want to keep a copy for your records).

Sheila is right. They may not have that information until the meeting. I would often not have our paperwork until the day of the meeting. Which I had to go pick up. Another note that those meeting notes may also not be available until the next meeting. It is usually the next meeting those notes are approved by the board. So if they meet once a month it could take you over a month to get the previous month's notes. Unless someone makes them available sooner by posting them or your HOA has a newsletter.

BB7, I see you would like to see the agenda (not "meeting notes"/minutes from a previous meeting). When is the annual meeting?

Some bylaws state how much notice owners must receive before an annual meeting of the members and also before Board meetings. Do your bylaws say anything about that topic?

If they don't, perhaps the state statures spell out requirements for your type of HOA. Most HOAs are corporations--usually nonprofit, so you would look for those statues.

If I remember correctly we are to have 2 weeks notice which has been given but no agenda and yes we can sign a proxy I just thought I would want to know what might be voted on.

Do look at the sources I suggested BB7. They should not only say that notice of the meeting needs to be given xx days in advance, but also that agendas need to be posted or made available xx days in advance.

Again, BB7, it depends on what your own docs or state statutes require. Requirements (of lack thereof) of other states may be very different from yours.
