If anyone has a clue what it would cost to have an attorney help with revitalization of EXPIRED CC&Rs, please let me know. It is important for budgeting purposes to have an idea of what it might cost a community. If you know or have been a part of revitalizing CC&Rs that have ALREADY EXPIRED, please let me know. Thanks.

I don't have the experience but the costs may vary widely. The best process I could recommend would be to find a local HOA attorney and get an idea of the cost; maybe check with several.

I would advise setting up a committee of volunteers to comb through the CCR's coming up with ideas, suggestions and updates to the CCR's. By doing this you would save money on attorney fees. Once all of the suggestions are completed, let the Board review, and then submit to the attorney for legal verbiage. Attorney’s can range from $100.00 per hour for a paralegal upwards of $250.00 per hour. Having a committee begin the process could save the association a lot of money.

It cost us about $750 in filing fees plus attorney costs. The actual notifications and sending notifications was another signicant cost. We had someone capable of making "free copies" to distribute to owners reducing some cost. I would estimate atleast $1,500 to $2,000 to update CC&R's altogether. It depends on the size of the HOA and effort it takes. Attorney and court costs vary for each state.
There are forms available at some major office supply stores to do some of this work. Look in the area of "selling your own home etc...". These forms cover many areas of HOA's and cost under $20.

Our HOA (164 units in CA)finished the rewrite of our CC&R's last year. It was a rather drawn out process due to some changes in the make up of the board at the time. A committee was formed and did a lot of work, then this was passed by our lawyer, then approved by the membership. It took about 2 years to totally complete and as I was not on the board at the beginning the the first years cost I cannot guarante. With Lawyer Costs, Filing Costs, Mailing Costs etc. We spent close to $20,000. We tried to save money by hand delivering the drafts to the members etc. Postage adds up quick. With changes in the laws in CA we are starting to consider redoing these again.
