I am on the board of my condominium and we have a condo owner who rents out bedrooms in her home. The condo documents prohibit the "commercial use" of one's home but she insists renting out bedrooms is "residential."

Which is it?

In my opinion, just as renting your home isn't considered "commercial use" renting a room or having a roommate to share the costs likely wouldn't be considered commercial use either. Now I would change my opinion if the rental was on a short term basis.

You may want to contact your County zoning department and see if they would define renting a room in the home (vs. renting the entire home) a commercial business. If they do, the Association would have a better standing. In fact, if they do, you could simply report the issue to the planning commission and let them do the enforcement on the owner.
