I'm currently on the board of our HOA, but will be moving out of state shortly and plan to rent out my unit.

The issue is that our bylaws state all board members must be owner occupiers, but out of our 22 units only 7 will now be inhabited by the owners, the rest are all rented. It seems like an unfair burden to place on the remaining 7, especially as nobody besides the other 2 current board members is even interested in doing it (and they don't even want to do it but we had no choice).

Should we take the necessary steps to allow non-resident owners to become board members?

You can try and see how everyone feels about that. It is up to the owners on how they want their community to run. So if they are comfortable with non-resident owners being board members then so be it. I can't speak for the rest of the majority of the owners on this subject. I was not a resident of my HOA for the last few months of my term. Granite I live in the next neighborhood over. It wasn't that much of a problem as long as I stayed on top of things.

If it's in the CC&Rs it will be rather difficult to change. 7 out of 22 is excessive however.

Are there any provisions for what happens if number is below 7?

Oops you said bylaws. Yes, you should try to reduce the number and be more flexible about requirements.

There is no reason why out of state owners cannot be board members/officers and run things. Simply conduct meetings with a old school conference call with a telephone, or go high tech with video skype or google hangout. I personally would not want a renter deciding on what "I" as an owner need to pay for.

There are 3 board members, I realize I did not directly state that. But yes, that leaves the burden on the remaining 7 owner occupiers (of course tenants do not have any say in the HOA, only owners).

I suppose we'll have to try and put it to a vote, if only we could get any of the absentee owners to give a crap about meetings.
