We want to introduce short adult/senior lap time in our community pool. The pool is open only during our Texas ISD summer vacation. We have also active swim team for children. The pool and life guards are the largest part of our HOA budget. Our senior and adults rarely use the pool because it is crowded by children and their friends not living in our community during the all opening season. Some members of the board are afraid that short adult lap time only might be against the law. Other proposition is that if the pool opening season gives advantage to one group of homeowners over other group there must be possibility to opt out from contributing to it. Can we distribute pool tags to interesting homeowners for a fee ?

I dont know the laws, but our local pool, owned by the city has adult/senior pool times. No kids.

My last country club had a 10 minute adult swim time per hour.

You all make the rules. Don't think anyone is going to go to jail over this. Many pools I used to go to had a 10 minute break time for adults or for life guards to check the pool. The life guards blew the whistle and everyone had to get out for 10 minutes. It was just a good safety practice too. Too many people you don't know if someone went under and never came up. So I would encourage a safety/adult swim time.

As a long time lifeguard, water safety instructor and pool manager, I can tell you that many pools implement "adult swim" for a period of between 10 to 20 minutes on the hour. All children under 18 must leave the pool during that period. This not only gives the adults a chance to use the pool unimpeded but also forces the kids, whose lips may be turning blue, to take a break that they otherwise wouldn't. That rest improves overall pool safety.

IMHO if some parent wanted to file a discrimination complaint over "senior swim time" they could have a valid claim. If you have a senior lap time you should also have a junior lap time or better yet just a plain lap time where any member could do laps.
