Hi,

Does anyone have a suggested template, or would care to share their HOA "rules" or CC&Rs for a 3 unit building? I am the default HOA President, we are self-managed and I need to revise our rules. The current version is one page, four bullets and doesn't cover much.

As laws differ between States, I would suggest doing a search on the internet for Associations in your State and visit the Associations website. Many have their governing documents online available for any visitors to view.

If you members here send them to you or you view them on the net, make sure you stick with only those from your State. Otherwise you run the risk of mistakenly not complying with a State statute.

Another possible source is an office supply store like Staples, Office Max, or Office Depot. There is a section of "Do it yourself" documentation. There are some that include only the paperwork and others a CD and paperwork. The most popular one in this section would be rental agreements. Which should get you to the right area if you ask a clerk. However, a lot of times the offerings are limited. You may have to go online to find them. They do have HOA like documentation like Incorporating and maybe some other related material. The cost is under $20 and accommodate each state in the directions.

If you do ever use the rental agreement and you live in a HOA, make sure to modify it to include the renter is aware of the HOA and to agree to follow the rules. This way you have more power to remove a bad tenant who is not adhering to the HOA rules. Otherwise the HOA will hold you the owner's feet on the ground and you can't do much about it. That's because following the HOA is not a written condition of your lease. So you can use off the shelf documentation but make sure to be able to modify it to your needs.
