When is it advisable for Condominium Boards to share Rules and Regulation changes with owners and why.

Sara, all R&Rs should be shared with every owner prior to enforcement. Why? Because it is the right thing to do. The question to ask is "why not?"

What Roger said, otherwise how are they supposed to know when they are violating one? Or when they inadvertently violate a rule they didn't know about, the HOA could put them on DOUBLE SECRET PROBATION.

Rules and Regulations should be shared with owners as they are written to make sure the majority of homeowners are OK with them. They shouldn't be an edit imposed but rather a policy endorsed by all.

In Maryland, condo law states that any new rule must be adopted at an open meeting after which 30% of the unit owners have 15 days to gather a petition to void any newly imposed rule.

Rules and Regulations should be made public as soon as the BOD implements them. If not, it indicates a secretive BOD and that is bad for all.

In CA, the Board proposes rule changes, which then go out to owner for a 30-day review period. After that period, the board meets again about the rule(s) taking owners' comments, if any, into account and votes to approve (or not). The change is immediately sent out to owers.

One think to learn about this chat forum is there can be big differences from state to state. In SC a BOD can make Rules and Regulations without any input nor approval from owners.

Now any BOD that does so might be stupido not to get owner input but none the less, in SC they do not need such.

That's why I wrote CA, John46--so that readers know their state may be different. I agree that advance notice of the proposed change gives all owners a chance to be heard and, yes, our Board actually listens to them. This benefits everyone.

A nice example was a longtime rule that bicycles may not be ridden on our premises (highrise condos with hardscape paths & a circular drive). When we did a rules overhaul a few years ago, an owner wrote to suggest that cyclists be permitted to ride their bikes from the bike storage rooms in our underground garage levels on the ramps that cars use, instead of walking them some distance to the exit/entrance gates. Since none of us directors are cyclists, we hadn't thought of it. We approved his revision to our rules.
