After 8 months that I attended a hearing, I received a pre-suit mediation to resolve my issue.

I built an structure in my back patio after verval approval. After that I received a letter tequesting remove the structure. I ask for a hearing and in the hearing they decide to discuss with their counsel and send me in writting their decision in the next 2 weeks. After the hearing, no any communication from the HOA was received , and after 8 months they send me the pre-mediation suit.

What is you suggestions in this matter ?

Yes, John . I stopped the construction for over 3 months after the hearing. I went on November to the Anual HOA meeting and nothing happened. I received my invoice in regards to the dues for 2013 and nothing happened.

After the hearing , they told me and my friend that is an attorney , that a letter would send in the next 2 weeks , and nothing happened .

How long has the HOA to make a decision in reference to a hearing? How much would be cost take this case in to the court?

Lets put aside everything for a moment........

What do your CCR/Bylaws say about building sheds such as this? Are they allowed at all? IF they are not allowed, even if someone did verbally say go ahead, did they have the authority to do so? If not, you can't have the shed, no matter what they said.

If they are allowed..... Did you follow the proper steps to get a shed approval? Maybe you can start following the steps starting now, and get it approved.

Depends on how far you want to take it. You could spend $25 or $2 million.
